Affiliate Program Terms

These Affiliate Program Terms govern participation in the Mt. Logos affiliate program (the "Program"), operated by Mt. Logos, LLC. The Mt. Logos Terms of Service apply to the Program in full; where these terms conflict with them, these control for Program matters.

Participation is by approval only. Generating or sharing a referral code means you agree to these terms.

1. Eligibility

• You must have an active Mt. Logos account in good standing, and be approved by Mt. Logos.
• You must be at least 18 years old to earn or receive payouts.
• You participate as an independent individual, not as an employee, agent, partner, or joint venturer of Mt. Logos, and have no authority to bind us or make representations on our behalf.

2. Your Referral Code

• Your code is personal to you and may not be sold or transferred.
• A new customer enters your code before their first payment. A code cannot be applied to an account that has already paid, and cannot be changed once applied.
• You may not apply your own code to your own account or to any account you control.

3. Commission

• You earn 25% of the amount we actually collect (net of discounts, excluding tax and payment-processing fees) on payments made by a customer who used your code.
• Commission is earned on payments made during that customer's first 12 months following the date the code was applied. Payments after that period earn nothing.
• Commission is earned only when a payment successfully clears. Signups, free trials, and comped accounts earn nothing.
• We may change the commission rate or earning period at any time. Changes apply only to commissions earned after the change takes effect.

4. Holding Period, Refunds, and Chargebacks

• Earned commission is held for 30 days before becoming available for payout.
• If a payment is refunded, reversed, or charged back, the related commission is void and will be deducted from your balance, whether or not it has already become available.
• If a voided commission has already been paid to you, we may offset it against future commissions.

5. Payouts

• The minimum payout is $10.00 USD in available commission, except in December, when any available balance may be paid out regardless of amount.
• Annual payout cap. Total payouts to you under this Program are capped at $1,999.00 USD for the 2026 calendar year (January 1 – December 31). This is a standard part of our payout cycle, the same way many referral programs use periodic payout minimums or annual caps for processing purposes. The cap may be adjusted for future calendar years; the amount that applies is the one stated in the then-current version of these terms.
• Any earned commission balance beyond the annual cap in a given calendar year is not forfeited. It carries forward and becomes payable starting the following January 1, subject to that year's cap.
• We may, at our sole discretion, approve a payout above the annual cap on a case-by-case basis. To request an exception, contact us directly by email or phone — exceptions are not automatic and are not guaranteed.
• You may request a payout at most once every 4 months, to keep payout processing efficient.
• You request a payout from within the Service. Payouts are made manually, by Venmo or another method we agree to, typically within 30 days of a valid request.
• You are responsible for providing accurate payout details. We are not responsible for funds sent to an incorrect account you provided.
• Unclaimed balances do not expire while your account remains active. If your participation is terminated for a violation of these terms, unpaid balances are forfeited.

6. Taxes

• You are an independent contractor for tax purposes and are solely responsible for all taxes on amounts you receive.
• Nothing is withheld from your payouts. You receive the full amount, and any tax owed on it is yours to pay later. Many people in this position set aside roughly 25–30% of each payout for that purpose. This is general information, not tax advice — consult a qualified professional about your own situation.
• If we pay you $600 or more in a calendar year, U.S. tax law requires us to collect a completed Form W-9 and to issue a Form 1099-NEC. We may withhold payouts until you provide a valid W-9.
• You are responsible for keeping your own records of amounts received.

7. Prohibited Conduct

You may not:

• Self-refer — apply your code to your own account, accounts you control, or accounts created on behalf of the same person or household.
• Create fake, duplicate, or automated accounts, or use unauthorized payment methods, to generate commission.
• Spam — send unsolicited bulk email, SMS, or messages, or post in any forum, group, or chat in violation of that community's rules.
• Bid on our brand terms ("Mt. Logos" or close variants) in paid search, or run advertising that impersonates us.
• Represent yourself as Mt. Logos, or use our name, logo, or trademarks in a way that suggests you speak for us.
• Make false or misleading claims about the Service, its features, its price, its results, or the terms of any discount.
• Register domain names, social accounts, or app listings using our names or confusingly similar variants.

8. Required Disclosures

If you promote Mt. Logos publicly — including posts, videos, stories, reviews, or messages to groups — U.S. FTC rules require you to clearly disclose that you may earn a commission. A plain statement such as "I get a commission if you use my code" satisfies this. You are responsible for your own compliance.

9. Voiding Commissions and Termination

• We may void any commission we reasonably believe resulted from fraud, self-referral, spam, misrepresentation, or any other violation of these terms.
• We may suspend or terminate your participation, disable your code, and forfeit unpaid balances for any violation.
• We may modify, suspend, or discontinue the Program at any time. If we discontinue it, commissions validly earned before that date and above the minimum payout will still be paid.
• You may leave the Program at any time by ceasing to share your code and requesting any available balance.

10. No Guarantee

We make no representation that you will earn any particular amount, or any amount at all. Figures shown in the Service are examples or your own historical results, not projections of future earnings.

11. Your Promotions Are Yours

You are solely responsible for everything you say, post, or send while promoting Mt. Logos, and for complying with all applicable laws — including FTC disclosure rules, anti-spam laws (such as CAN-SPAM and the TCPA for text messages), and the rules of any platform or group you post in.

You agree to indemnify, defend, and hold harmless Mt. Logos, LLC from any claim, penalty, damage, loss, or expense (including reasonable attorneys' fees) arising out of your promotional activity, your statements about the Service, your failure to disclose your commission, or your violation of these terms or any law. We may also void any related commission and terminate your participation.

12. Disclaimers, Liability, and Dispute Resolution

The Disclaimers, Limitation of Liability, Time Limit on Claims, Indemnification, and Dispute Resolution / Arbitration / Class Action Waiver sections of the Mt. Logos Terms of Service apply to the Program and are incorporated by reference. Our total liability relating to the Program will not exceed the commission validly earned and unpaid to you. These terms are governed by the laws of the State of Utah.
